Who is covered by the producer responsibility?

The producer responsibility applies to companies that are the first to make textile products available on the Danish market:

  • Companies that manufacture textile products.

  • Companies that import textile products to Denmark.

  • Companies that sell products under their own name or trademark – even if they do not manufacture them themselves.

  • Danish webshops that sell imported textile products in Denmark.

  • Foreign webshops that sell textile products directly to Danish customers – both consumers and businesses.

The crucial factor is not who manufactures the product, but who first makes it available on the Danish market just like for packaging.

Do you sell through an online platform?
Online platforms must ensure that producers who sell through the platform for Denmark comply with their producer responsibility before the products can be marketed and sold in Denmark.

The producer responsibility applies to businesses that are the first to make textile products available on the Danish market. This could be:

  • Manufacturers who produce textile products.

  • Importers who import textile products to Denmark.

  • Companies that sell products under their own name or brand – even if they do not manufacture them themselves.

  • Danish webshops that sell imported textile products in Denmark.

  • Foreign webshops that sell textile products directly to Danish customers – both consumers and businesses.

The crucial point is not who produces the product, but who first makes it available on the Danish market, just like for packaging.

Micro-enterprises are not exempt from producer responsibility, but the scheme for micro-enterprises has a one-year later entry into force, and will therefore presumably only apply from April 17, 2029. In addition, micro-enterprises, just like for packaging, will have significantly reduced reporting requirements and are therefore expected to be subject to fewer administrative burdens.

The producer responsibility for textiles will encompass more than clothing. This applies to both products for households and businesses. It includes, among other things:

  • Clothing – e.g. jackets, hats, trousers, socks

  • Leather and synthetic leather – e.g. belts, gloves, shoulder straps

  • Home textiles – e.g. blankets, tableware, linens, curtains

  • Footwear – all forms of footwear.

It has not yet been decided whether mattresses will be included under producer responsibility in Denmark. The final list of included products will only be available once the Danish regulations are in place.

Until then, you will be able to see CN codes for the included products in the directive's Annex IVc

In the fall of 2027, you are expected to report an estimate of how many kilos of textiles you anticipate making available in 2027. At the same time, you must choose the producer responsibility organisation for textiles that you will be affiliated with in the DPA register.

When the producer responsibility is scheduled to enter into force in April 2028, you will need to report your actual quantities to the producer responsibility organisation you have chosen from then on.

You must report the quantities in kilos and distribute them among the relevant product types. The final product types will be determined in the upcoming statutory order. Until then, the EU's CN codes can be used as a starting point to identify and categorise your products.

Get an overview of the covered CN codes

The prices have not yet been established. As a producer, you must pay for, among other things, the collection, sorting, reuse, and recycling of discarded textiles, as well as administration and support for research and development.

The price is expected to be calculated based on the weight of the textiles and may be eco-modulated according to the lifespan of the textiles.

VANA expects that the prices per kilo will at the earliest be known by the end of 2027 or close to the expected entry into force in April 2028. We are working to ensure that the prices are clarified as early as possible so that businesses can budget for the costs.

In addition, there will be an administration fee to the authorities, similar to what is known from producer responsibility for packaging.

Yes, the producer responsibility for textiles also includes requirements for eco-modulation, similar to what we know from packaging. This means that products with a long lifespan, high quality, and containing recycled fibers will have to pay less than products with a short lifespan, low quality, and that are more difficult to recycle. However, the criteria have not yet been established and are expected to be set as part of the work on the Eco-design regulation.

Yes, it is a requirement to be a member of a producer responsibility organisation for textiles. It is also a requirement that producers from other EU states with producer responsibility in Denmark must have an authorised representative, such as VANA.

No, pre-registration is non-binding at VANA and also free of charge. You gain access to the latest knowledge in the field, guidelines, webinars, and newsletters.

The government still needs to decide how the producer responsibility for textiles should be organised and implemented in Denmark. In a response to the Parliament, the Minister of Climate, Energy and Utilities, Samira Nawa, states that a decision is expected to be in place during the autumn. After that, both a bill and a statutory order will be presented. VANA will of course keep you updated on this.
