Status and legislation
The producer responsibility for packaging will come into force on 1 July 2025, but the companies covered will already be required to register between 1 April and 31 August 2024. Get the complete overview of the implementation of the legislation leading up to July 2025 here.
The producer responsibility for packaging has been adopted in the EU and will be implemented in Denmark in the Environmental Protection Act and an implementing executive order. The implementation is based on a political agreement, concluded on 30 August 2022, between the Social Democrats (government at the time of the agreement) and the Liberal Party, the Socialist People's Party, the Radical Left, the Red-Green Alliance, the Conservative People's Party, the Danish People's Party and the Alternative.
The executive order contains the specific rules for the producer responsibility and will be implemented in two phases from mid-2023 until July 2025.
The first part contains, among other things, a definition of the concept of a producer and information on what information companies must report when registration with DPA opens in April 2024. Learn more about covered companies, packaging types and registration- and reporting obligation.
Part 1 of the executive order sets out the framework for:
- manufacturer definition
- obligation to register
- producer registers.
The first part of the executive order has been submitted for consultation in May 2023 - read VANA's consultation response here.
Due to postponement and many consultation responses, the executive order has been issued for new consultation until 31st August 2024 and is expected to come into force on 1 April 2024, when registration and reporting will open at DPA.
Part 2 of the executive order sets out the framework for:
- organisation and framework for responsibility and transfer
- take-back schemes
- compensation, etc.
- producer responsibility for drinking cups
- criteria for environmental modulation
- service levels and possibly also formula for commercial packaging waste.
Part 2 of the executive order will be submitted for consultation from the end of May to the end of July 2024 and is expected to come into force from 1 July 2025.
