Take-back scheme

A company can arrange for the take-back of packaging waste, which originates from the company's own made available packaging as well as from similar packaging, at its own expense and ensure that it is waste treated in accordance with the rules in the statutory order on packaging.

Reusable packaging is essentially a take-back scheme. Read more about the rules for reusable packaging.

Single-use packaging in take-back scheme

Companies can choose to handle the collection of packaging waste that originates from their own made available packaging and similar packaging. A company that puts packaging on the market can also be a waste-producing company for what it generates as waste. If a company has not actively established a take-back scheme, the packaging is part of the general collection system, and this does not mean that they have a take-back scheme. Read more about this.

Take-back

The take-back itself must occur either by:

  • the company collecting the packaging waste from end users (only in connection with the delivery of a new product if it is in households), or
  • the end user delivering the packaging waste to the company or to a location or area designated by the company from where you or your supplier send it for waste treatment.

Obligation regarding awareness raising measures

Companies with a take-back scheme must ensure that end users of the packaging are informed in sales and information materials, including in user manuals or at the point of sale, about where and how they can dispose of packaging waste in the take-back scheme.

Waste Treatment – Recycling

Companies with take-back responsibilities are obligated to ensure waste treatment of the collected quantities. The waste treatment must meet the requirements for high recycling in accordance with the regulations. Read more about the requirements for recycling.

Reporting

Companies that have a take-back scheme must make two types of reports:

  1. available quantities: Quantities placed on the market
  2. collected quantities: Quantities of packaging waste collected in a take-back scheme.

Both available quantities and collected quantities are reported to VANA, which is responsible for the annual, mandatory reporting to Dansk Producentansvar (DPA). Continuous reporting of quantities in the take-back scheme has not yet been decided, as there are still some unresolved elements regarding the rules that need to be clarified. We will inform you as soon as there is clarification. Compensation for commercial waste for quantities taken back in a take-back scheme cannot be applied for. Read more about compensation.

Self-control mechanism

Companies with a take-back scheme must conduct self-control to ensure the following:

  • that they finance the take-back and handling of packaging waste
  • that they finance the obligation regarding awareness raising measures towards end users of packaging
  • the quality of the collected and reported data on made available packaging
  • the quality of the collected and reported data on the waste quantities of packaging waste that you have collected in a take-back scheme
  • that they comply with the requirements of the European Parliament and Council Regulation No. 1013/2006/EC of June 14, 2006, on the shipment of waste as amended.

The company must prepare a written description of the procedure and documentation for the execution of the self-control. Self-control must be carried out at least once a year. The description and documentation must be made available to the Danish Environmental Protection Agency upon request. If the company outsources the task of collecting and treating waste from third parties, you must use weigh slips or other documentation from the third party as part of their self-control of data on collected and treated packaging waste.
