Check if your company is covered

All companies that put a packaged product on the market will be responsible for financing and organising the collection, sorting, and treatment of their packaging waste. It is estimated that this corresponds to approximately 41,000 companies in Denmark.

The general rule is that the producer responsibility belongs to the company, who first markets packaging or a packaged product on the market. 

On this page you can see when you as a company become responsible and thus must register and report packaging quantities.

Who is covered - Manufacturer definition
The
manufacturer, importer or distributor who first makes the packaging or filled packaging available, which means that:

  1. Anyone who manufactures or has produced transport-, reuseable packaging, primary production packaging or service packaging or filled packaging in own name or trademark (brand) has the producer responsibility. This means e.g. that if you manufacture or import transport packaging which is resold to companies that use (fill them), you are responsible, unless you have manufactured the packaging in their name.
  2. Suppliers offering transport, recycling, primary production, service, sales or multipack packaging to microenterprises (even if produced in the name of the microenterprise) have producer responsibility. This means, for example, that if you manufacture service packaging for a micro-enterprise, you have producer responsibility, even if you have manufactured the packaging in the name of the micro-enterprise. 
  3. Companies established outside Denmark are given producer responsibility if they make packaging or filled packaging available via distance selling directly to end users. This means, for example, that your foreign suppliers may be responsible for e.g. transport packaging if you repackage products and turn the transport packaging into waste.

If there is doubt as to whether a company is covered, it is Danish Producer Responsibility (DPA) that, as registry authority, can make a final decision on producer responsibility.

Manufacturer: Any manufacturer, importer or distributor who, irrespective of the selling method used, including distance selling:

(a) is established in Denmark and makes transport packaging, reusable packaging, primary production packaging or service packaging available for the first time on the Danish market.

(b) is established in Denmark and makes filled packaging or packaging not referred to Article 1(a) available on the Danish market for the first time or

(c) is established in another EU Member State or in a third country and makes transport packaging, reusable packaging, primary production packaging, service packaging or filled packaging available directly to end-users on the Danish market for the first time via distance selling.
