VANA demands supervision: Allocation errors create unreasonable price differences

Dansk Producentansvar has refused to adjust the allocation between the producer responsibility organisations (PRO). Therefore, VANA has now lodged a complaint with the Danish Environmental Protection Agency (EPA) and requested supervision of DPA's management, urging for prompt action to ensure a fair, transparent, and stable producer responsibility system.

Unfair competitive conditions

The current allocation among the producer responsibility organisations creates unfair competitive conditions. It is a crucial mistake that producers under 8 tonnes have not been included in the allocation. This is evidenced by the price differences that have been debated in the press since the summer.

VANA has therefore repeatedly asked Dansk Producentansvar (DPA) to adjust the allocation (find VANA's consultation response here). Since DPA has now definitively rejected this, VANA has asked the Environmental Protection Agency to oversee DPA's management. This is based on the fact that:

  • the current allocation is based on DPA’s serious error regarding the absence of allocation for producers under 8 tonnes.
  • there have been significant changes in the market shares of the producer responsibility organisations due to the very large group of companies that only registered after the mandatory deadline.

"When thousands of law-abiding companies' reported quantities are not included in the allocation, we get a system where members of some producer responsibility organisations pay too much and others too little – and where the differences are not due to the efficiency and priorities of the producer responsibility organisations, but errors in the system. Neither the companies nor the producer responsibility organisations can benefit from this."

Severe economic consequences

The lack of adjustment of the allocation has serious economic consequences and creates unreasonable and opaque competitive conditions, as some producer responsibility organisations are allowed to postpone their collection obligations until the next allocation period. Here they will then face double allocation for the amounts of the late-registered companies.
