The producer responsibility for packaging has been decided in the EU and implemented in Denmark in the Environmental Protection Act and a statutory order on packaging, which contains the specific rules for producer responsibility.

Danish legislation - executive order
Packaging:
- Statutory Order on certain requirements for packaging, extended producer responsibility for packaging and other waste collected with packaging waste (Danish) - Updated on the 29th of September 2025
- Changes to the order under consultation until June 10 - August 12 (Danish)
- Changes to the order under consultation - deadline: 19th of September (Danish)
The order was submitted for consultation with a deadline of August 12th to ensure that the producer responsibility organisations (PRO's) that have been obliged to take over waste through emergency allocation, can have their actual, documented costs covered via the financial guarantee during the period until a new allocation comes into effect.
The order was resubmitted for consultation on September 13th with the aim of implementing the government’s political announcements. Read more about the political agreement on the framework for producer responsibility for packaging in place.

Political agreement
The implementation of the producer responsibility is based on a political agreement, which was agreed on the 30th of August 2022.
